Moonstories is developed by HK IReader Technology Limited (hereafter referred to as “we” or “us”).
This user agreement (hereinafter referred to as “Agreement”) is entered into between Moonstories and Moonstories's users (hereinafter referred to as “Users”), concerning the installation, usage and related matters of “Moonstories” application (hereinafter referred to as “Moonstories” or “Software”). By clicking "I agree" or other ways to accept the Agreement, you acknowledge that you have reached an agreement with Moonstories and accept all the following terms and conditions.
We reserve the right, at our discretion, to change, modify, add, or remove portions of the Agreement at any time by posting the amended version on relevant pages with/without prior notice. Continued use of the service after updating constitutes acceptance of the revised Agreement. If you do not agree with the revised terms, you must not access or use the service. We also reserve the right to cease offering any of the services.
Users must (i) read through and accept this Agreement before installing, downloading, visiting or any other ways to use Moonstories, (ii) download Moonstories from websites or media appointed by us. Moonstories has no willful or grossly negligent obligations or liabilities on any possible risks and/or losses caused by Users' breach of this Agreement.
Users shall confirm that they have reached the legal age to use online services; minors shall use the service under the supervision of guardians.
2.1 We are the copyright owner of Moonstories. All intellectual property rights in and related to Moonstories, as well as information content, including but not limited to novels, text representations and combinations thereof, icons, graphic decorations, images, charts, colors, interface designs, layout frameworks, associated data, additional programs, printed materials or electronic documents, are protected by copyright laws and international copyright treaties as well as other intellectual property laws and regulations. Users shall not reverse engineer, decompile, or disassemble Moonstories without our prior written approval.
2.2 Users acknowledge that any texts, images, graphic materials of the network service provided by Moonstories are protected under copyright, trademark and/or other property ownership laws. Without our prior written approval, foregoing information shall not be used (i) directly or indirectly published or played in any media, (ii) rewrote or republished for the purpose of publication or playing, or (iii) used for any other commercial purposes. All or any parts of the information shall only be available for private and non-commercial purpose to be saved in Users' terminals.
Moonstories has no obligations or liabilities to any Users or third parties on any damages and/or losses caused by (i) the delays, inaccuracies, errors, omissions of the information, (ii) during the transmission or submission of the information or any parts hereof.
3.1 When users first use Moonstories on their personal device, we will assign a unique UID to users automatically. Users can log-in and bind this UID with Apple account, Google account, Facebook account or others. This will ensure the security of users' account assets, and help users check their viewing record and/or unlocked (purchased) viewing history.
3.2 If users uninstall/remove Moonstories without logging in and binding their UID, all the information (including but not limited to behavior records, viewing records, unlocked viewing history, and purchased history) and assets under the Moonstories Account may be permanently deleted. When users install and use Moonstories again on a different device, we will assign them a new UID. Users shall be solely responsible for any consequences arising from a UID change and/or assets losses due to actions such as data erasure, application uninstallation, or reinstallation.
3.3 Users have the right to delete his/her Moonstories Account, but all the information (including but not limited to behavior records, viewing records, unlocked drama history, and purchased history) and assets under the Account will be deleted permanently. Please pay attention to these issues before deletion.
3.4 Users shall be responsible for his/her personal behaviors under the UID, and pay attention to the security of UID, including but not limited to the password and other relative information.
3.5 We have the right to disable, suspend, ban or delete user accounts, temporarily or permanently, when Users disobey local laws, regulations or our User Agreement.
4.1 Moonstories is an application available to be downloaded, installed and used for non-commercial purpose.
4.2 Internet fees may be caused and charged by the mobile operator during downloading and using of Moonstories. Users shall consult local mobile operators for details.
4.3 Moonstories provides a variety of dramas and supports in-app purchase functions, enabling users to make payments for products they are interested in or wish to acquire. However, Moonstories gives Users a specific prompt before charging. Users can press "Cancel" or "Back" to cancel, and then Moonstories will not impose any fees.
4.4 Moonstories accepts payment through Google Pay, Apple Pay and others. When making a purchase, users must ensure that they possess a valid payment method. Responsibility for payment failures due to issues with user's personal account and/or payment method shall be borne solely by the user. Users are deemed to have accepted Moonstories's payment methods by accepting this Agreement.
4.5 All products purchased by users within Moonstories are priced in United States Dollars (USD). Users should carefully consider their purchase decisions prior to making a purchase. Unless otherwise stipulated in this Agreement or relevant laws and regulations, the fees paid upon successful completion of a purchase are generally non-refundable.
4.6 Moonstories provide subscription services with subscription periods on a weekly, monthly, and yearly basis. (i) All amounts are payable and charged for one-time purchase at the time Users conclude their orders. Upon completion of the payment processing, your subscription shall commence; (ii) Users can cancel their subscription at any time, and if not canceled, the subscription will be automatically renewed upon expiration of the last service period; (iii) Users will not receive a refund for fees already paid for the current subscription period. We will continue to provide the services until the end of User's current subscription period.
4.7 US dollar is the standard payment currency of Moonstories. If Users purchase with other local currency which is supported by Moonstories, the amount of the local currency may be varied with exchange rate at the time when users making payment.
4.8 Virtual-Coins can only be used on Moonstories, no matter how Users get them through charging or granted by Moonstories. We reserve the right to change, correct or enrich the respective “currency” names. Unless otherwise specified, Virtual-Coins can only be used within Moonstories and hold no purchasing power in other scenarios. Also, virtual-Coins cannot be used for any other purposes, such as transactions with third parties, trading on third-party platforms, or exchange for any currency. If you violate the foregoing requirement, we shall not burden any losses of you or a third party, and if we reasonably suspect that your Account or usage involves cheating operation or abnormal transactions, we reserve the right to suspend, refuse your use of Virtual-Coins, until relevant relief measures are taken as provided in this Agreement.
You promise not to recharge through illegal or unauthorized channels. If you violate the rules and illegally recharge or purchase Virtual-Coins, we do not guarantee that the recharge will be successfully completed. We will not compensate your losses if your rights and interests are damaged as a result of the above actions. We also reserve the right to terminate, restrict your Account, your right to recharge, and pursue your liabilities according to this Agreement.
UNLESS OTHERWISE REGULATED BY LAWS AND REGULATIONS, ALL PURCHASES OF VIRTUAL COINS MADE THROUGH THE SERVICES ARE FINAL, NON-REFUNDABLE, NON-TRANSFERABLE UNDER ANY CIRCUMSTANCES. FOR AVOIDANCE OF DOUBT, IN REGARDING ANY SERVICES AND PRODUCTS PURCHASED BY YOU, YOU ARE NOT ALLOWED TO REFUND OR TRANSFER THE VIRTUAL COINS TO OTHER SERVICES OR PRODUCTS.
4.9 You confirm that we shall not be responsible for losses arising from our inability to provide virtual currency service or any issues in providing Virtual-Coins caused by the following reasons:
• Due to loss, ban or freezing of your Account;
• Your password is disclosed for theft or misappropriation of your user names, passwords and etc.;
• Due to faults of any payment channel institution;
• Caused by intentional or gross negligence or violation of Laws and Regulations of other users;
• Other reasons caused by yourself.
Moonstories will implement reasonable security measures to protect users' payment information and ensure the security of the payment process. However, users shall understand and accept that there exist inherent security risks in any transactions conducted over the internet. Moonstories shall not be liable for any payment security issues arising from users' own reasons or factors attributable to third parties.
5.1 Users represent and warrant to use Moonstories (i) legitimately and honestly, (ii) without infringing any third party's legitimate rights and interests.
5.2 Users represent and warrant not to spitefully delete, change, add functions or data saved in the application, or designedly avoid or destroy technical measures of us for the protection of Moonstories. Users shall take all risks and responsibilities caused by their breach of this term. In case Users involve Moonstories into any illegal activities or breach the purpose of this Agreement, we have the right to stop providing services to Users immediately and reserve the right to investigate and pursue the responsibilities of Users through judicial channels.
5.3 Users represent and warrant not to (i) imitate Moonstories’s products and services for commercial purposes, (ii) copy or imitate design philosophy, interface, functions and charts of Moonstories, or (iii) modify or create other derivative products of Moonstories without our prior written approval.
5.4 Users shall not use Moonstories or its services to make, upload, copy, send, and share contents that violate applicable laws and regulations.
5.5 Users shall take all responsibilities for compensation to Moonstories and/or others' losses caused by their breach of this Agreement. Should Moonstories take such responsibilities, Users shall compensate Moonstories for related costs and losses, including reasonable attorney's fees.
5.6 Users acknowledge that breach of any of the above representations and warranties or rules and/or notices of Moonstories may result in immediate termination of their use of Moonstories without any refund or prior notice.
5.7 Users agree to accept all information services and other services provided by us while using Moonstories.
6.1 We have the right to modify and update Moonstories at any time based on the needs of operation and network environment, and may make prior public announcement for major function or service adjustments.
6.2 In case Users breach this Agreement while using our services and cause losses to us, we have the right to take measures, including but not limited to stopping licenses and services, restrictions for use, investigating and pursuing legal liability, etc. Users may have the right to submit an appeal for account restriction or service suspension.
6.3 Moonstories may, in its sole discretion, discontinue provision of Moonstories at any time without liability and/or notice to Users. If overall service termination is required due to operation adjustment, we may issue a public notice in advance and provide proportional refund services for paid users for unexpired rights.
Users acknowledge that Moonstories shall not be liable for the following conditions, including but not limited to:
7.1 System problems caused by hurricanes, earthquakes, tsunamis, floods, electrical outages, war, terrorist attacks, etc. (“Event of Force Majeure”).
7.2 Service problems caused by hacker attack, telecom department technical adjustments or failures, website update, bank problems, etc.
7.3 Within the scope of permitted by law, Moonstories may not necessarily be responsible for any technical issues, such as (i) Moonstories has no technical bugs, (ii) fixes all bugs of Moonstories. While, Moonstories cannot warrant the services meet all needs of every User.
7.4 The only solution to dissatisfaction with this Agreement or Moonstories is to stop using Moonstories.
By subscribing to, opening and using the Moonstories membership auto-renewal service (hereinafter collectively referred to as "Auto-Renewal Service"), you agree to these rules.
Auto-renewal is an optional function, and no default automatic deduction should be set without user’s explicit consent. You understand and agree that:
8.1 If you open this Auto-Renewal Service and do not explicitly cancel this Auto-Renewal Service during the Subscription Period, the relevant entity will automatically deduct the balance from your own top-up account, bound third-party payment account, bank card, communication account, and etc. (hereinafter collectively referred to as "Accounts") 1 day prior to the expiration of each Subscription Period. The service fee for the next subscription period will be automatically deducted from the balance of your Accounts, so as to extend the validity period of the corresponding subscription period. You should pay attention to the status of the above-mentioned accounts and debitable balances, and you will bear all the risk and/or loss due to account problems or insufficient balance resulting in renewal failure.
8.2 Subscription period: one week, one month, one year, and etc. (subject to the description on the subscription page), and members can choose accordingly by themselves.
8.3 Moonstories can offer a free trial to new subscribers of paid services. If you choose/purchase a paid service subscription that includes a free trial, you will be able to use the paid service for free during the free trial period. At the end of the applicable free trial period, you will be charged the subscription fee and will continue to be billed until you cancel your subscription willingly. In order to avoid any charges thereof, you must cancel by yourself before the end of the free trial period.
8.4 You acknowledge and agree that Moonstories has the right to adjust the price of the service. If Moonstories intends to adjust the price of the service after you activated the auto-renewal service, we will notify you in advance by appropriate means (including but not limited to onsite announcements, SMS, etc.). If you do not agree to the service price adjustment, you may cancel this auto-renewal service in accordance with these rules. If you do not cancel this auto-renewal service, the subsequent service fees deducted by the relevant entity will be based on the adjusted service fees. If you cancel within 24 hours/one day before the expiration of the subscription period, the relevant entity may stop deducting the service fees for the next subscription period. After the cancellation of this auto-renewal service, if you open the auto-renewal service again, the service fee automatically deducted by the relevant entity shall be based on the service fee displayed on the page at that time.
8.5 The unsubscribe method for auto-renewal users is as follows.
If you have purchased a paid service subscription for auto-renewal, you can cancel the subscription at any time before the end of the current validity period, and the cancellation will take effect in the next billing period. You will retain access to the paid service until the end of the current validity period.
(1) Apple IAP (in-app purchase) payment: Open "Settings" of your iOS device --> go to "iTunes Store and App Store" --> click "Apple ID", select "View Apple ID", enter the "Account Settings" page, click "Subscription", and select Moonstories membership to cancel the subscription. If you do not cancel the auto-renewal feature 1 day prior to expiration of the current subscription period, the subscription will be renewed and and the subscription fee will be debited automatically.
(2) Google Play Store: Go to google play --> click "Settings" --> click “Subscriptions", and select Moonstories membership to cancel your subscription. If you do not cancel the auto-renewal function 1 day prior to expiration of the current subscription period, the subscription will be renewed and the subscription fee will be debited automatically.
(3) TikTok Minis: Open TikTok Minis --> find LuckyDrama and enter --> tap the "..." in the upper right corner --> tap "Subscription" in the pop-up menu --> select cancel the subscription. If you do not cancel the auto-renewal feature 1 day prior to expiration of the current subscription period, the subscription will be renewed and the subscription fee will be debited automatically.
8.6 We may also stop providing auto-renewal service to users according to our operation strategy, and your Moonstories membership will be terminated upon the expiration of the current subscription period.
User Agreement is written in English and may be translated into other languages. In the event of any conflict, ambiguity or inconsistency between the English version and other language versions, the English version shall prevail.
9.1 Users agree that this Agreement shall be governed by and construed in all respects in accordance with, the laws of the Hong Kong SAR. Any dispute arising out of or in connection with this Agreement, including any questions regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre in accordance with the Arbitration Rules of the Hong Kong International Arbitration Centre for the time being in force with one arbitrator. The seat of this arbitration shall be Hong Kong, The language of the arbitration shall be English.
9.2 Any term of this Agreement, for whatever reason, completely or partially invalid or unenforceable or in violation of any applicable laws, shall be deemed to be deleted. Other terms of this agreement shall remain valid and have binding force.
